Terms of Service

Modellus is software that mortgage professionals use to manage loan files, collect and review documents, communicate with borrowers, and track their pipeline.

We are not a lender, mortgage broker, credit reporting agency, or provider of legal, financial, or tax advice. We do not originate loans, make credit decisions, or set loan terms. Any calculation, summary, program suggestion, or generated text the platform produces is a starting point for a licensed professional to review — never a commitment to lend, an approval, or advice to a borrower.

• You must be at least 18 and use the platform for business purposes.
• You are responsible for the accuracy of your account information, for keeping your credentials secure, and for everything done under your account.
• Account owners control which team members have access and what each role can do. Granting someone access makes you responsible for their use.
• Tell us promptly if you suspect unauthorized access.

You keep ownership of everything you put into the platform. You grant us the limited license needed to host, process, and display it in order to run the service for you.

You are responsible for having the right to upload borrower information and for obtaining the consents the law requires — including permission to contact people by email and to text the loan file contacts you approve for text messages, as described below. You agree to comply with all laws that apply to your business, including the Gramm-Leach-Bliley Act, RESPA, TILA, ECOA, the TCPA, and applicable state licensing rules.

You agree not to:

• Send unsolicited marketing, or message anyone who has not consented or who has opted out.
• Upload malware, attempt to breach security, or access another account’s data.
• Use the platform to discriminate unlawfully against any applicant.
• Resell, reverse engineer, or copy the platform, or use it to build a competing product.
• Overload the service, including through automated requests beyond documented API limits.

We may suspend an account that puts the platform, its other customers, or message deliverability at risk.

Email. Emails you send through Modellus may go out under your name and from your connected mailbox, and remain your responsibility. You confirm that every email recipient has given you the consent the law requires, that you honor opt-out requests, and that you will not use the platform for unsolicited marketing.

Text messages. Text messages are sent by Modellus AI LLC from +1 (305) 938-9541, and every one begins with “Modellus:” and ends with opt-out instructions; your name may appear in the body. The platform texts the contacts of a loan file — borrowers and co-borrowers, and the other parties to the transaction (real estate agents, title, escrow, insurance, HOAs, appraisers, attorneys, and others) — that you, as the loan officer handling the loan, have added to the file and approved texting. You are responsible for having permission to text every contact you approve. A contact can also opt in by checking the SMS consent box on the intake form, the pre-qualification quiz, or the borrower portal, or by texting START or YES to +1 (305) 938-9541. Anyone who replies STOP is never texted again until they reply START, and you cannot turn texts back on for them. Text messages are limited to that loan — documents, conditions, status, reminders, portal sign-in codes, and customer care — never marketing.

Text messaging is subject to our messaging terms. Carriers may filter, delay, or block messages, and we cannot guarantee delivery.

The platform connects to services you choose — your mailbox, your loan origination system, your storage. Those connections are governed by the terms of the provider, we access them only as you instruct, and you can disconnect them at any time. We are not responsible for a third-party service being unavailable or changing how it works.

Paid plans are billed in advance for the period you select. Fees are non-refundable except where the law requires otherwise. We will give notice before a price change takes effect, and you may cancel before it does.

The platform, its software, and its branding belong to Modellus AI LLC. These terms do not transfer any of it to you beyond the right to use the service while your account is active.

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any output is accurate or suitable for a particular loan.

To the maximum extent permitted by law, Modellus AI LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

You agree to defend and indemnify Modellus AI LLC against claims arising from your use of the platform, your content, your messaging, or your violation of these terms or of any law.

You can cancel at any time from your account settings. We may suspend or terminate an account that breaches these terms. On termination you may export your data for 30 days, after which we may delete it.

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located there.

We may update these terms. If a change is material we will notify account owners by email before it takes effect. Continuing to use the platform after that means you accept the change.
